2. Purpose
These Terms of Use ("Terms") govern access to and use of the Klayn platform, accessible via the website and API (hereinafter "the Platform").
Use of the Platform implies full acceptance of these Terms of Use.
3. Service Description
Klayn is a platform for generating e-commerce content using artificial intelligence:
- Visual content
- Text content
- Video animations
- Virtual models and custom sets
4. Registration and Account
4.1 Account creation
Access to the Platform requires creating an account via OAuth authentication (Google, Facebook, Apple).
4.2 Required information
During registration, the user provides: first name, last name, brand name, store URL (optional), industry, content language.
4.3 Account responsibility
The user is responsible for the confidentiality of their credentials and all activity performed from their account.
4.4 Single account
A user may only create one account.
5. Credit System
5.1 Principle
All content generation consumes credits. Credits are purchased in packs via Stripe.
5.2 Available packs
- 1,000 credits: €10 excl. tax
- 5,000 credits: €50 excl. tax
- 25,000 credits: €250 excl. tax (+ 3,000 bonus)
- 100,000 credits: €1,000 excl. tax (+ 25,000 bonus)
5.3 Validity
Purchased credits are valid indefinitely.
5.4 Credit deduction
Credits are deducted when the generation is actually launched.
5.5 Generation failure
In case of technical failure, credits are automatically refunded within 1 minute.
5.6 Auto-reload
Users can configure automatic top-up by setting a threshold and a reload pack. Maximum 1 top-up attempt at a time.
5.7 Non-refundable
Credits are non-refundable and non-exchangeable, except as required by law.
6. API Usage
6.1 API access
Each user has a unique, personal API key accessible from their account. This key is strictly confidential.
6.2 Rate limits
The API is subject to rate limits detailed in the technical documentation.
6.3 Webhooks
Users can configure webhooks to receive generation completion notifications.
6.4 Media URLs
The URLs provided to retrieve generated media are strictly reserved for file retrieval. Any other use (embedding on websites, social media, public sharing, etc.) is prohibited. Users must download the media and host it on their own infrastructure.
7. Generated Content
7.1 Ownership
The user is the sole owner of content generated via the Platform.
7.2 Use by Klayn
Klayn retains no rights over generated content and does not use it to train its artificial intelligence models.
7.3 Retention
Generated content is retained for 12 months from creation, then automatically deleted.
7.4 Download
The user is responsible for downloading and backing up their content before expiration.
8. Prohibited Content
It is strictly prohibited to generate via the Platform:
- Illegal content (counterfeiting, defamation, hate speech, etc.)
- Pornographic or sexually explicit content
- Content infringing on third-party rights
- Content violating applicable laws
In case of violation, Klayn reserves the right to suspend or delete the account without notice or refund.
9. Brands and Models
A user can manage multiple brands. Each brand has its own identity. The user must maintain at least 1 active brand. Models and sets created are linked to a specific brand. Deleting a brand permanently deletes all associated content.
10. Personal Data
Klayn is committed to complying with the GDPR. The data collected (first name, last name, email, brand information) is used solely for the operation of the service and billing. Users have the right to access, rectify, delete, and port their data via hello@klayn.ai
11. Availability and SLA
Klayn commits to providing 99.9% service availability (SLA). Maintenance operations may be performed with prior notice.
12. Liability
The user is solely responsible for the source content they provide and warrants that they hold all necessary rights. Klayn cannot be held liable for the use of generated content, indirect damages, or temporary service interruption.
13. Account Deletion
Users can delete their account at any time. Deletion is permanent and results in the loss of all data, brands, creations, and remaining credits (non-refundable).
14. Changes to the Terms
Klayn reserves the right to modify these Terms at any time. Users will be notified by email of any changes.
15. Governing Law
These Terms are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the courts of Nice.
